License & Commercial Use

1. Plans & Rights

Free Plan

• Commercial use: Not allowed
• Personal use: Allowed (education, hobby projects, social media for personal accounts)
• Attribution: Not required, but appreciated

Standard & Pro Plans

• Commercial use: Allowed for active subscribers only
• Rights: Perpetual license to images generated during your subscription period, even after cancellation
• No attribution required: You own the commercial rights to your generated images

2. What Is "Commercial"?

Commercial use includes, but is not limited to:

• Selling prints, merchandise, or products featuring the generated images
• Using images in advertising, marketing materials, or promotional content for businesses
• Incorporating images into products or services sold for profit
• Using images in client work or projects you're paid for
• Publishing images in books, magazines, or other paid media

Non-commercial examples: Personal blog posts, school projects, hobby art shared on social media, educational materials for free courses.

3. Ownership & Copyright

• Generated images: You retain ownership of images you generate
• AI training: We do not use your generated images to train our models or third-party AI systems
• Responsibility: You are responsible for ensuring your prompts and generated content do not infringe on third-party intellectual property (characters, logos, trademarks, etc.)

4. Prohibited Content

Regardless of your plan, you may not generate or use images that:

• Depict illegal activities or content
• Contain hate speech, harassment, or discriminatory content
• Violate third-party intellectual property rights
• Impersonate real individuals without consent
• Contain explicit NSFW content prohibited by our AI providers

Violations may result in immediate account termination without refund.

5. Attribution (Optional)

While not required, we appreciate attribution:

• Free users: "Generated with Nano Banana 2" (link to nano-banana2.app)
• Paid users: Attribution is optional but appreciated

6. AI Provider Terms

Nano Banana 2 uses various AI providers (Google Gemini, OpenAI, Replicate, etc.). By using our service, you agree to comply with their respective terms of service. We are not liable for changes to their policies or service interruptions.

7. Takedowns & Reports

If you believe content generated on our platform infringes your rights:

• Email us at support@nano-banana2.app with details and proof of ownership
• We will review and remove infringing content within 48 hours

8. Term & Termination

• Free plan: License terminates if content violates our policies
• Paid plans: Commercial rights remain valid for images generated during your active subscription, even after cancellation
• Account termination: We reserve the right to terminate accounts that violate these terms

9. Limitation of Liability

• Nano Banana 2 is provided "as is" without warranties
• We are not liable for third-party claims arising from your use of generated images
• Maximum liability is limited to the amount you paid in the last 12 months
